Selectmen's Meeting Minutes, 12/17/2008
Minutes of Meeting – December 17, 2008; meeting called to order at 7:00 pm.  
Present:  RN Sandlin; L Messana; J McNinch; KR Flynn; S. Pavlosky.
MOTION by RNS, seconded by LM to accept the Minutes and Executive Minutes of December 3 as presented.  5/0 vote.

Members of Green Berkshire requested that the discussion of the boundary lines to the ACEC be postponed until January 7.  MOTION by LM, seconded by KRF to approve a contract with Green Berkshires, Inc. in the amount of $5000 and to authorize the TM to sign same.  5/0 vote.

The clerk read the advertisement for a change of manager and alteration of premises for Shakespeare & Company’s liquor license.  MOTION by RNS, seconded by JM to open the public hearing.  4/0 vote.  Lori Robbins appeared before the Board to answer any questions they had regarding these proposed changes.  The Board questioned the controlling of outdoor drinking.  Staff will patrol the areas in question, and selling will take place inside at the bars.  Ms. Robbins then asked the Board to consider amending their closing time from midnight to 1:00am on Thursday-Sunday.  MOTION by RNS, seconded by LM to close the public hearing.  4/0 vote.  MOTION by RNS, seconded by JM to approve the change of manager and alteration of premises as presented, and to amend their closing time to 1:00am on Thursday-Sunday.  4/0 vote with KRF abstaining to all votes

The Board reviewed the various license renewals for calendar year 2009.  MOTION by RNS, seconded by LM to approve all license renewals as presented.  In addition, those with outstanding issues to be given 60 days to come into full compliance.  5/0 vote with noted abstentions for individual establishments.

MOTION by RNS, seconded by LM to grant permission to Donald Rawson to sell Christmas trees at his property on Housatonic Street from 9-5 from now until Christmas Eve.  5/0 vote.

MOTION by KRF, seconded by LM to appoint Ellen Jacobsen as the Housing Authority’s representative on the Affordable Housing Committee, and to appoint Debra Burke as a full member of the Affordable Housing Committee.  5/0 vote.

MOTION by JM, seconded by LM to grant a temporary 14-day sign permit for the Yankee Candle Company.  5/0 vote.

Old/New Business:  LM went through the employee anniversaries.  KRF had several questions regarding Town Meetings and voting, with a focus on how to maximize citizen participation.

By roll call, SP, LM, RNS, KRF and JM voted to go into Executive Session at 7:55 p.m. to discuss current negotiations with the DPW and Fire Department.
